The inevitably of taxes, and their consequences on real wealth creation, constantly occupy the thoughts of many people. In fact, some spend more time on planning how to minimise taxes than on any other aspect of their financial life. However, a failure to prepare properly for the other inevitability - death - can undo a whole life of work, tax efficient planning and careful investment.

There are two areas of potential disaster which can suck in the unwary: intestacy and drawing up your own will. The first and most important activity when approaching succession planning is to ensure your personal planning is up to date. You need to ask yourself the following:

  • Is your Will up to date?
  • Do you have a current Enduring Power of Attorney?
  • Do you wish to prepare an Advance Health Directive (“a living Will”)?
  • Who actually has a claim to your estate?

We would remind you that making a Will may be one of the most important things you do. Quite simply, a Will is the only way to ensure that your wishes are carried out. It should detail the distribution of all your property and assets, funeral arrangements, bequests to charitable organisations and may possibly include instructions regarding the gift of treasured possessions to particular friends and family members.
